Rep. Bierlein plan provides freedoms, flexibility for farmers who seek multiple uses of their property

State Rep. Matthew Bierlein has introduced legislation that gives farmers more freedom as they seek to make a living.

The new plan addresses zoning ordinances and states they can’t prohibit barns or other facilities located on agricultural land from being used as commercial venues for weddings or similar events.

The legislation doesn’t prohibit regulation for noise, advertising, traffic, hours of operation or other conditions that may accompany different uses. Bierlein, of Vassar, noted that the plan was carefully designed to not trample on local authority to manage those aspects effectively.

Bierlein introduced similar legislation during the 2023-24 term after speaking with individuals who own property zoned for agriculture in his district that spans portions of Bay, Genesee, Saginaw and Tuscola counties.

“I have talked with many people who own properties that can double as event venues in the summer and fall,” Bierlein said. “They want to be able to provide these services for customers and with the costs of staying in business rising, these opportunities can help them stay afloat. By permitting the use of these spaces, we can foster the growth of local businesses, create job opportunities, and contribute to the overall vitality of our communities.”

Bierlein also said the legislation protects property rights and provides clarity going forward for both communities and property owners, as some land owners in Michigan have used ambiguous language in existing ordinances to operate commercial venues – such as declaring it seasonal agri-tourism.

House Bill 4006 was referred to the House Agriculture Committee for consideration.
